Construction & Growth in Puerto Vallarta

Neither PVRPV or property owners or their representatives shall under no circumstance be held responsible for any disturbance, construction noise, dust/debris or inconvenience the guest may experience while occupying the vacation property. Whether this caused by the actions of the neighboring buildings, units within the same complex, construction, renovations, mandatory repairs, public service workers or unforeseen circumstances in the surrounding area, NO refunds, reimbursements, discounts or future credits can be issued. This would also include and is not limited to the closure of condo common areas for upgrades and / or repairs. These situations are completely beyond our control and are the result of robust and growing communities.

Due to the continued and constant investment, growth, upgrades and renovations in Puerto Vallarta, from time to time there may be a minor interruption of public services including hydro, water or sewer or the lack thereof. Although this is not a common problem in PV, it can happen.

Property Policy


- ALL properties represented by PVRPV are NON SMOKING this includes; patios, terraces, outdoor spaces attached to or a part of a Vacation Rental Property - if smoking takes place inside the property – you will be obligated to pay, a fine, an extra cleaning fee and you may be evicted.

- Clients shall not remove any item/s from the property, such as kitchen appliances, glassware, furniture, or any other item.

- The use and enjoyment of the property does not include illegal activities such as the use of illegal drugs, prostitution, selling of goods (illegal or otherwise) and/or kidnapping, this is strictly prohibited.

- Excessive noise that may affect neighbors will be strictly sanctioned as per the local building rules and regulations established by the property that you are occupying.

- PVRPV guests and/or the visitors of the guest(s) are responsible to adhere to the rules, regulations and polices of PVRPV and/or the individual property policies thereof. Failure to obey the rules and policies established will be asked to vacate the property without the right to any refund.

The responsibility to know or adhere to the policies, rules or regulations are the responsibility of the guest.

NO SMOKING
No smoking inside the property, the unit, on the terraces / balconies, or common areas.

OCCUPANCY POLICY
Maximum occupancy of 4 people in the unit.
The number of persons stipulated on the guest’s Booking and the confirmation email is the maximum number of people allowed to stay at the vacation property. If more guests arrive to stay / occupy than stated on the Booking Confirmation, they may be denied occupancy. In the event they are permitted to check-in an extra charge may apply.

VISITOR POLICY
The number of visitors must not exceed the maximum occupancy of the unit.
Only guests registered and confirmed in your booking are allowed to occupy the unit.
No overnight visitors are allowed.

PET POLICY
1 Dog under 12kg is welcomed in the unit, please consider a $500 USD deposit (CASH) is required upon arrival and returned upon check-out after an inspection and no damage in the unit.
Pets are not allowed in common areas.

NOISE RESTRICTIONS
NO HIGH VOLUME or NOISE between 10:00 pm until 9:00 am, including Speakers, Music, Televisions, etc. inside of the unit.

POOL POLICY
Please refer to the section "ROME ENCORE CONDOMINIUM REGULATIONS "
The use of the POOL is at your own RISK.
NO glassware in the pool or around the pool. PLASTIC glasses and stemware only.
NO Pool Parties.
NO Running around the pool area.
NO Urinating in the pool. Please use the washrooms in the room next to the pool.
PLEASE SHOWER or RINSE prior to using the pool.

COMMON AREA POLICY
Please refer to the section "ROMA ENCORE CONDOMINIUM REGULATIONS"

GUEST KEYS
You will be issued 1 set of keys for each person noted on the Booking Confirmation. Keys must be returned in the same condition as received at the time of CHECK OUT.
PLEASE NOTE: Should you lose a set of keys the cost is $50USD ($1,000 pesos) for each lost-unreturned or damaged key or set of keys. Please have this fee prepared to be collected by the concierge at the time of check-out. This Fee is NOT covered by the guest damage insurance.

ROME ENCORE CONDOMINIUM REGULATIONS

The provisions of this regulation aim to regulate the establishment, modification, organization, operation, administration, and termination of the vertical condominium property regime, as well as the rights and obligations of the condominium owners. Simply by being a condominium owner, whether as an owner, tenant, occupant, or visitor of any dwelling, the following obligations are incurred, regardless of those contracted by the decision of the Condominium Assembly.

Rights and obligations of condominium owners regarding common elements:

Respect and comply with this regulation and the Construction and Ecology Regulations of the municipality, as well as others applicable to healthy coexistence.
Each condominium owner may use common property and enjoy general services and facilities according to their nature and ordinary destination, without restricting or making more burdensome the rights of others.
Take responsibility for not leasing, lending, or assigning, in any way, the possession of their home to individuals who:
Endanger the tranquility and decorum that must be observed in the condominium.
Do not agree to fully respect the Regulation, presenting themselves to the administration to sign acceptance and acknowledgment of the regulation.
Do not store machines that, due to their size, number, and nature, represent a threat to the safety and aesthetics of the condominium and its occupants, as well as hazardous, flammable, and/or unauthorized substances by law.
Owners or tenants, as well as their family members or visitors, have the obligation to comply with the rules established in this Regulation. In any case, owners are responsible for the actions and behaviors of their visitors and dependents (drivers, bodyguards, service personnel in general, etc.). These dependents cannot use common areas of the building or stay within them.
It should be noted that each person over 6 years old is considered an occupant. Owners exceeding the maximum occupancy must pay a penalty of 2,000.00 pesos per person per night.
Observe moral and decent conduct in the Condominium, urging family members, friends, visitors, guests, and/or employees to observe the same behavior. The condominium owner is responsible for the behavior and actions of the mentioned individuals.
Condominium owners must notify the administration if there are lease contracts, along with their duration, and ideally send notice with a minimum of 24 hours before arrival, including names, number of guests, and check-in/out dates for general control.
When guests are staying in their condominium during their absence, it is necessary to send a written notice of the number of people, the name of the responsible party, and the dates they will be using the unit. The notice should be directed to the administration ideally at least 24 hours before the guests' arrival.
Dispose of garbage in the garbage room located in the interior parking of the condominium, in closed bags. Under no circumstances should they be placed in hallways or entrance doors. Do not include any type of glass in the bags; these should be personally taken to the designated garbage room by the owner to avoid accidents in handling. Similarly, recyclable materials such as cardboard, wood, and packaging elements of purchased items, which, due to their size, may saturate or block the garbage room.
Notify tenants, occupants, and visitors of their obligations and rights within the Condominium to ensure full compliance with this Regulation.
Take necessary measures to prevent accidents, disasters, contingencies, or thefts in their homes.
Use the private area exclusively for housing purposes, and any other use is prohibited.
Do not produce noises, sounds, disturbances, or odors that threaten the tranquility and comfort of the Condominium. Do not circulate toys or any type of devices that generate noise in the common areas of the condominium.
Avoid leaks and leaks that affect neighbors. In case of occurrence, immediate repairs are mandatory.
Avoid gas and water leaks and, in case of occurrence, give immediate notice to the administration and competent authorities to prevent incidents within the condominium, as well as repair immediately. In the event of absence from the residence, the administration is authorized to take the necessary measures and, if necessary, enter the private unit to safeguard the integrity of other owners, their properties, and common goods.
All condominium owners are obligated to maintain their respective private units and ensure them for their destructible value against fire, earthquake, explosion, or any other disaster that may endanger them, covering the premiums caused by it.
No activity that is dangerous, unhealthy, or annoying may take place. Each condominium owner must have a fire extinguisher against all types of flammable or combustible materials within their private unit and take the necessary measures required by the Civil Protection Law for each case.
Condominium owners cannot change, modify, paint, decorate, or vary in any way the exteriors of their private units, in their finishes, walls, ceilings, doors, handles, horseshoes, varnish tones, paint, texture, etc., unless these modifications are made by mutual agreement with the other condominium owners or are for the required maintenance to keep them in good condition and appearance. In the case of balconies, condominium owners cannot make modifications to their structure and use.
No occupant of the property may use or obstruct the entrances and passages, leaving any object that hinders the transit of people in them, as these services are intended for common use.
Each condominium owner can use their unit and dispose of it, with the limitations and prohibitions established in the Civil Code of the State of Jalisco.


PROHIBITIONS

Condominium owners and, in general, occupants of the condominium may not, without the consent of the General Assembly and in accordance with applicable laws:

Perform any act that affects the tranquility and comfort of other condominium owners and occupants or compromises the stability, safety, or health of the condominium, nor engage in omissions that produce the same results.
Carry out acts outside or inside their private unit that hinders or makes the operation of common services and general facilities ineffective, limits or hinders the use of common areas, or jeopardizes the safety or tranquility of condominium owners or occupants.
Perform works or repairs during nighttime hours, except for reasons of force majeure.
Knock down or transplant trees and change the use or nature of green areas.
Modify, alter, or destroy common-use areas.
Prohibited from using the condominium maintenance staff for services other than their function. Therefore, all condominium owners must refrain from offering gratuities to employees in exchange for receiving services other than those related to their functions.
Install curtains on the exterior view, hallway, or facade of a different color than beige or white. Place decorative elements in hallways and facade walls, such as pots, plants, pictures.
Prohibit hanging clothes, sheets, towels, rugs, etc., on the balconies of the units and in hallways.
Do not make visible connections or wiring from the outside. Do not nail nails, bolts, hooks, or screws outside your private property, or even inside if it affects neighboring homes.
Strictly prohibited to walk naked or topless and expose oneself to exhibitionism. Any violation of this clause will result in a fine of $2,000.00 pesos for the owner and total restriction to the building for the person identified by the cameras.
Strictly prohibited for condominium owners to introduce orchestras or musical groups or any type of live music into their homes. The sound equipment used cannot be used at a volume that causes disturbance to other condominium owners.
Do not throw substances prohibited by municipal regulations, such as flammable, corrosive, or greasy liquids, into the drains.
Do not use parking spaces that do not belong to you.
The use of poisons, herbicides, pesticides is restricted to domestic types and will be used under the responsibility of the condominium owner and only within their private area.
Do not reprimand other condominium owners, tenants, occupants, and visitors, as well as interfere in any way in their activities. Any complaints in this regard must be submitted to the Administrator.
Do not introduce substances, products, or instruments into the Condominium that jeopardize healthy coexistence and are prohibited by law.
Suppliers, service providers, domestic employees, and personnel hired for remodeling and modifications must adhere to the schedule set by the administration.
Entry to the condominium will be restricted, and only visitors, family members, suppliers, and service providers will enter as long as the owner grants them access.
In the entrance to their private area, planters or ornamental plants cannot be placed, and these are limited to being within their property.
Strictly prohibited the use of electric, gas, or charcoal grills inside the residential units or on the terrace of the unit. Remembering that there is a BBQ area on the roof for the use of condominium owners.
Violators of these provisions and others outlined in this regulation and the Civil Code for the State of Jalisco, regardless of the sanctions established in this regulation, will be responsible for the payment of damages.


COMPLIANCE WITH THE REGULATION AND SANCTIONS

The sanctions for each violation of this regulation will be as follows:

Upon the first violation, the offender will receive a written warning from the assembly, the administrator, or the Board of Directors, which will be delivered or sent to the address registered with the administrator or the Condominium Assembly as official or where they are found, or via email. It will detail the violation of the provisions of this regulation. Before imposing any sanction, the offender will be granted the right to a hearing to present their case in person or in writing within forty-eight hours. If they appear, their argument will be heard, recorded, and the appropriate measures will be taken. If they do not appear, a record will be made, indicating that they were duly notified, and the sanction will be imposed.
Upon recurrence, the offender will be subject to a sanction equivalent to 2,000 pesos.
Upon a second recurrence, the offender will be subject to a sanction equivalent to 5,000 pesos.
Upon more than two recurrences, the offender will be subject to a sanction equivalent to 10,000 pesos.
In case the condominium owner fails to pay these sanctions, the Administration is authorized to collect them through the Maintenance fees, which could result in a delay in payment, causing the restriction of services provided by the Condominium, as well as access to the common areas of the building.
In the event that any condominium owner violates the Municipal construction regulations, the administrator and the Board of Directors will be empowered to notify the competent authority.
The sanctions will be charged to the condominium owner in the statement issued by the Administrator. However, when a condominium owner, occupant, or visitor fails to remedy, within the following 30 days from the first written notification that points out the violation of this regulation, the Administrator is authorized to take the following measures:
Suspension of services: The Administrator may suspend the services provided by the condominium to the condominium owner, occupants, or infringing visitors, including the use of common areas.
USE OF THE GYM

The following provisions must be observed when using the GYM:

Gym hours are from 6:30 AM to 9:00 PM from Monday to Sunday.
Wear suitable sports clothing and footwear when entering.
Use of a hand towel for sweat is mandatory to enter.
Under no circumstances should anyone enter or remain shirtless in the gym area.
Do not bring food into the area; if you need a drink, use a plastic container.
Do not play or run within the area.
Respect and take care of the area and the schedule.
Minors under 18 years of age are not allowed in the gym area.
Each user will be responsible for accidents or injuries due to the misuse of equipment and economic consequences resulting from them.
To use the gym, it is your responsibility to know and verify your health status, which will indicate if you are fit for its practice.
Do not move or take gym equipment.
The use of speakers is not allowed; only personal headphone devices should be used.
At the end of your routine, each user must turn off the air conditioning and clean and arrange the equipment used as a courtesy to the next user.


USE OF THE SWIMMING POOL

The following rules must be observed when using and staying in the swimming pool and the pool area:

Private use of the pool is prohibited.
Hours are from 9:00 AM to 10:00 PM from Monday to Sunday.
Children under 8 years of age must be supervised and monitored by an adult.
There is no lifeguard; therefore, the use of the pool is at your own risk.
Music is allowed at levels that do not disturb other users of the common areas. In case the music is annoying to those sharing the area, the administration will ask to lower the volume or turn off the music and/or use headphones.
The administration is not responsible for forgotten objects.
Shower before entering the pool to remove creams, oils, ointments, sand, etc., to protect the condition and health of the water.

Prohibited activities:
Making bonfires or moonlit gatherings.
Introducing drinks and food into the pool.
Running near the pool area.
Performing physiological needs inside the pool.
Throwing garbage into the pool.
Entering with inappropriate clothing (pants, dress, shorts, etc.).
Using the pool outside the permitted hours.
Introducing glass and/or aluminum objects.
Playing any ball game.
Smoking in Common Areas anywhere in the building.


USE OF THE BBQ AREA
When using the BBQ area, the following rules must be followed:
Hours are from 9:00 AM to 10:00 PM from Monday to Sunday.
Private use of the area is not allowed.
Share the BBQ area with others if it was not reserved for private use.
Use aluminum foil in the grease tray.
Clean the area after use (remove the garbage) and take it to the designated area.


USE OF PARKING
Rules for parking use:
Parking is restricted only to the cars of owners who have purchased a parking space. Condominium owners must respect the parking spaces of other condominium owners and cannot use unoccupied spaces.
Do not park campers, motorhomes, trailers, boats, vessels, or any kind of mobile unit in the parking lot that is not a car or motorcycle, either permanently or periodically.
