A FEW THINGS TO KEEP IN MIND ABOUT RETENTIONS:
- We, like all rental platforms / agencies, are obligated by Mexican Tax Law, to retain taxes on all payments of bookings.
- This is a retention of taxes, not a payment. The retention of taxes towards the income.
- Those with RFC, the ISR (income tax) retention is 4% and those without an RFC, the ISR (income tax) retention is 20%.
- Once these retentions have been paid / filed we cannot request back ISR retentions (Even in the event of a booking cancellation).
- In the event of a cancelled booking / guest refund, those with an RFC number, will be able to correct the ISR retentions when filing their monthly taxes with their accountant. Those without an RFC number, will not be able to correct the ISR retentions already submitted.
- Property owners with an RFC will be able to claim expenses & operating costs against their ISR (income tax).
- Property owners without an RFC, the 20% ISR retentions are collected from those bookings and submitted to a general tax account with SAT (Mexican tax office). Because there is no RFC (tax number) affiliated with that submission, there is no way to track those payments to use as a deduction in the future once you receive an RFC number.
Over the last couple of years their have been many changes to the Mexican tax law. They are making every effort to make sure incomes made in Mexico pay taxes in Mexico.
